TERMS & CONDITIONS

1.1 Membership Agreement

This Agreement constitutes a legally binding contract between the gym facility (hereinafter referred to as "the Gym") and the individual or entity seeking membership services (hereinafter referred to as "the Member"). By signing this agreement and/or using gym facilities, the Member agrees to abide by all terms, conditions, rules, and regulations outlined herein.

1.2 Membership Eligibility

Minimum age requirement: Members must be at least 16 years of age (only for Gym Section on 1st Floor)
Clearance maybe given if a minor (under 16) is under parental guidance on the floor
Members under 18 years must have parental/guardian consent
Medical clearance may be required for certain membership categories
The Gym reserves the right to approve or deny membership applications at its sole discretion

1.3 Membership Categories and Duration

Monthly membership: Renewable on a month-to-month basis
Annual memberships: 12-month commitment with advance payment
Short-term membership: Available for 3, 6, or 9-month periods
Lifetime memberships: One-time payment with permanent access (where applicable)
All memberships are subject to the specific terms outlined in the membership application

2. PAYMENT TERMS AND CONDITIONS

2.1 Membership Fees

All membership fees must be paid in advance as per the selected payment plan
Membership fees are non-refundable except in cases determined by the management
Goods and Service Tax (GST) and other applicable taxes, if applicable, will be charged additionally

2.2 Payment Methods

Cash payments
UPI payments

2.3 Fee Structure

Registration/Initiation fee: One-time non-refundable payment
Monthly subscription fees: Based on membership category
Personal training fees: Separate charges for individual coaching sessions

3. GYM RULES AND REGULATIONS

3.1 Facility Access

Members must carry their membership card/access key at all times
Access is granted only during operational hours as displayed at the premises
Sharing of membership cards or access keys is strictly prohibited and will result in membership termination

3.2 Prohibited Activities

Smoking, vaping, or use of tobacco products anywhere on the premises
Consumption of alcohol or illegal substances
Commercial activities or personal training by non-authorized individuals

4. LIABILITY WAIVER AND ASSUMPTION OF RISK

4.1 Health and Medical Clearance

Pre-existing medical conditions must be disclosed to gym management
Members with health concerns should obtain medical clearance before beginning any exercise program
The Gym is not responsible for providing medical advice or supervision

4.2 Assumption of Risk

Members acknowledge and understand that:

Physical exercise involves inherent risks including but not limited to muscle strains, injuries, or more serious medical conditions
The Gym is not liable for injuries sustained during workouts
Members participate in all activities voluntarily and at their own risk
Equipment malfunction or accidents may occur despite proper maintenance

4.3 Release of Liability

Members hereby release and hold harmless the Gym, its owners, employees, contractors, and agents from:

Any claims arising from personal injury, death, or property damage
Accidents occurring on gym premises or during gym-sponsored activities
Negligence by gym staff (except in cases of gross negligence)
Loss or theft of personal belongings

4.4 Indemnification

Members agree to indemnify and reimburse the Gym for any costs incurred due to:

Legal action arising from the member's conduct
Damage to gym property caused by the member
Breach of membership agreement terms

5. CANCELLATION AND REFUND POLICY

5.1 Cancellation Procedure

In-person cancellation by notifying the management or supervisor present

5.2 Refund Policy

No refunds for payments made.
For annual or half-yearly memberships, refund will be under the discretion of the management as per exceptional circumstances.

5.3 Early Termination Fees

Cancellation before minimum contract period: 1 month’s fees as penalty
Outstanding dues must be cleared before cancellation processing

5.4 Exceptional Circumstances

Waiver of cancellation fees may be considered for:

Medical conditions preventing gym usage (doctor's certificate required)
Death or permanent disability

6. HEALTH AND SAFETY REQUIREMENTS

6.1 Emergency Procedures

First aid kits and emergency contact numbers are prominently displayed
Automated External Defibrillators (AEDs) available in facilities
Staff trained in basic first aid and emergency response

6.2 Equipment Maintenance and Safety

Daily equipment inspections conducted by qualified staff
Regular maintenance schedules for all gym equipment
Immediate removal of faulty or damaged equipment from service
Safety guidelines and proper usage instructions displayed on all equipment

6.3 Facility Hygiene Standards

Regular sanitization of equipment and common areas
Adequate ventilation systems maintained
Clean restroom and changing facilities
Water fountains and hydration stations available
Professional cleaning services engaged for deep cleaning

7. MEMBER CONDUCT AND DISCIPLINARY ACTIONS

7.1 Code of Conduct

Members must:

Treat staff and other members with respect and courtesy
Follow all posted rules and staff instructions
Report safety hazards or inappropriate behavior immediately
Maintain confidentiality regarding other members' personal information

7.2 Prohibited Behavior

Harassment, intimidation, or discriminatory behavior
Use of profanity or inappropriate language
Unauthorized commercial activities or solicitation
Violation of dress code or hygiene standards
Misuse of gym property or equipment

7.3 Disciplinary Actions

Violations may result in:

Verbal warnings for minor infractions
Written warnings with documentation
Temporary suspension of membership privileges
Permanent termination without refund for serious violations
Legal action for criminal behavior or property damage

8. PRIVACY AND DATA PROTECTION

8.1 Personal Information Collection

Member information collected for legitimate business purposes only
Data stored securely and accessed only by authorized personnel
Information may be used for marketing purposes with member consent
Medical information treated with strict confidentiality

8.2 Photography and Video Policy

The Gym may take photographs/videos for promotional purposes
Members consent to use of their image in marketing materials
CCTV, with video and audio, surveillance for security purposes operates throughout the facility

9. AMENDMENTS AND MODIFICATIONS

9.1 Policy Changes

The Gym reserves the right to modify terms and conditions with 30 days' notice
Changes will be communicated through posted notices and/or email
Continued use of facilities constitutes acceptance of modified terms
Major changes may require new membership agreements

9.2 Membership Transfers and Upgrades

Memberships are non-transferable
Upgrades will be done as available

10. DISPUTE RESOLUTION

10.1 Grievance Procedure

Members should first address concerns with gym management
Formal complaints must be submitted in writing
Response provided within 15 business days
Escalation to senior management if resolution not achieved

10.2 Legal Jurisdiction

All disputes subject to Consumer Protection Act, 2019 provisions
Jurisdiction limited to courts of Kolkata
Arbitration clauses may apply for certain types of disputes
Members retain rights under applicable consumer protection laws

11. SPECIAL PROVISIONS

11.1 Force Majeure

Gym not liable for service interruptions due to natural disasters, government orders, or unforeseen circumstances
Membership extensions may be provided for facility closures beyond gym's control
No compensation for temporary service reductions

11.2 Compliance with Law

All terms subject to applicable Indian laws and regulations
Compliance with GST, labor laws, and consumer protection requirements
Regular updates to maintain legal compliance
Professional legal review of terms and conditions
